Terms of Service

1. Acceptance of Terms​

Welcome to AIhubMix (hereinafter referred to as "we," "this service," or "AIhubMix"). These Terms of Service ("Terms") constitute a legal agreement between you and AIhubMix regarding your use of our services. By accessing or using our website, API, or related services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Service Description​

AIhubMix is a large model (LLM) API aggregation platform that provides access to various AI models, including but not limited to OpenAI, Claude, Gemini, and others. Our services allow users to call these models through a unified API interface and provide additional features such as real-time online search. AIhubMix is currently in a testing phase; we may change or discontinue any part of the service at any time, including the availability of certain models. Some models marked as "experimental" are under evaluation to determine whether they receive sufficient usage and whether they meet our operational economics, and they may be removed at any time.

For the removal of non-experimental models, we will take the following measures:

  • Provide notification on our official community channels
  • For a certain period, we will reroute requests for that model to another model with similar pricing and functionality
  • After a grace period of at least 2 weeks, we will stop rerouting requests for that model and return a 404 error instead

3. User Eligibility and Account Security​

3.1 Age Requirement​

Any person under the age of 13 is prohibited from using AIhubMix. You represent that you are at least the legal age of majority in your jurisdiction of residence, or if you are not of legal age, your parent or legal guardian must agree to these Terms and confirm that they accept these Terms on your behalf and assume responsibility for your use.

3.2 Registration Requirements​

Using our services may require creating an account. You agree to provide accurate, complete, and up-to-date registration information and are responsible for maintaining the accuracy and completeness of that information.

3.3 Account Security​

You are responsible for maintaining the confidentiality of your account, including the security of your password, and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

3.4 API Key Security​

You must keep your API key secure. A leaked API key may lead to unauthorized use and additional charges. We are not responsible for any loss or damage resulting from the leakage of your API key.

4. Service Use Rules​

You agree to use our services only for lawful purposes and to comply with all applicable laws and regulations. You shall not use our services to engage in any illegal or prohibited activities.

4.2 Prohibited Conduct​

You shall not:

  • Use our services to create, upload, or distribute any illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content
  • Infringe on the rights of others or any applicable laws
  • Reverse engineer, decompile, disassemble, translate, or otherwise attempt to discover the source code or underlying components of our models, algorithms, and systems
  • Abuse, harm, interfere with, reverse engineer, or disrupt our services, models, or their underlying technologies
  • Attempt to circumvent any usage restrictions or access undisclosed service features
  • Interfere with or disrupt the normal operation of the service or the servers or networks connected to the service
  • Engage in any activities that may impose an unreasonable or disproportionate burden on the service
  • Use automated methods to collect any information from the service unless explicitly permitted by us
  • Resell, rent, or otherwise commercialize our API without our explicit written permission
  • Represent that content generated by AIhubMix is human-generated

4.3 Content Responsibility​

You are solely responsible for all materials sent through our API and any results received from the models (collectively referred to as "your content"). You retain all rights to your content. We do not monitor or control the content you create or process using our services and are not responsible for such content.

5. Fees and Payments​

5.1 Pricing​

Our services may incur charges. Current prices and billing terms are published on our website and may change from time to time. All fees are quoted in US dollars unless otherwise stated.

5.2 Billing Method​

We charge based on API call volume, token consumption, or other usage metrics. The specific billing method depends on the service plan you choose and the models you use.

5.3 Payment Method​

Users can purchase credits to pay for model fees using payment cards or cryptocurrency wallets. Credits are non-refundable and can be used to pay for model fees and can be recharged at any time. Credits may expire 12 months after purchase.

We use third-party payment processors to securely handle payments. Non-cryptocurrency payments may incur additional processing fees. If we receive a fraud dispute or any refund related to fraud for any of your payments, you will lose the corresponding amount of credits and the costs of handling the dispute.

Developers can pay for model fees themselves or allow users to pay through an authentication process. When using your own provider API key (via integration), we will deduct the corresponding service fees from your account.

5.4 Refund Policy​

All fees are non-refundable unless required by applicable law. For prepaid users, unused balances may be refunded after account closure, depending on our policy at that time.

6. Intellectual Property​

6.1 Our Intellectual Property​

The service and its original content, features, and design are protected by intellectual property laws. Using our services does not transfer any intellectual property rights to users or developers. AIhubMix and its licensors retain all rights, title, and interest in the service.

6.2 Your Content​

You retain all rights to the content you create or upload through our services. However, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display such content solely to the extent necessary to provide and improve our services.

6.3 Feedback​

If you provide us with any suggestions, ideas, or feedback regarding our services, you agree that we may use such information without restriction and without any compensation to you.

7. Service Availability and Modifications​

7.1 Service Changes​

We reserve the right to modify, suspend, or terminate the service (or any part thereof) at any time without notice. We are not liable for any such modifications, suspensions, or terminations.

7.2 API Changes​

We may update our API from time to time. We will make reasonable efforts to provide notice of significant changes, but you are responsible for ensuring that your applications are compatible with the latest version of the API.

7.3 Service Level​

While we strive to provide high availability services, we do not guarantee that the service will be uninterrupted or error-free. We are not liable for any loss or damage resulting from service interruptions, delays, or other performance issues.

8. Limitation of Liability​

8.1 Disclaimer​

The service is provided on an "as is" and "as available" basis, without any express or implied warranties. We expressly disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability​

To the maximum extent permitted by law, AIhubMix and its suppliers, partners, or affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service, including but not limited to loss of profits, loss of goodwill, loss of data, or other intangible losses.

8.3 Indemnification​

You agree to defend, indemnify, and hold harmless AIhubMix and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising from: (a) your use of the service; (b) your violation of these Terms; or (c) your content infringing the rights of third parties.

9. Third-Party Services and Content​

9.1 Third-Party Models​

Our services provide access to third-party AI models. These models are provided and controlled by their respective owners, and we are not responsible for their performance, accuracy, or availability.

9.2 Third-Party Content​

The service may contain links to third-party websites or services or include third-party content. We do not control, endorse, or assume any responsibility for such third-party websites or content.

10. Termination​

10.1 Your Termination​

You may stop using our services at any time. If you wish to delete your account, please follow the instructions on our website.

10.2 Our Termination​

If you violate any provision of these Terms, we may suspend or terminate your access to the service without notice. We also reserve the right to terminate any user's access at any time for any reason or no reason, but will notify you.

10.3 Effects of Termination​

Upon termination, your rights to use the service will immediately cease. The provisions related to ownership, warranty disclaimers, indemnification, and limitations of liability shall survive termination.

11. Privacy​

Our collection and use of your personal information are described in our Privacy Policy. By using our services, you agree to our collection and use of such information in accordance with the privacy policy.

12. Dispute Resolution and Applicable Law​

12.1 Dispute Resolution​

Any disputes arising from or related to these Terms or your relationship with AIhubMix under these Terms shall be resolved through binding arbitration.

12.2 Applicable Law​

This agreement is governed by the laws of the state of Delaware, USA, and interpreted in accordance with its laws, without regard to any conflict of law principles.

12.3 Entire Agreement​

These Terms constitute the entire agreement between you and AIhubMix regarding the use of the service and supersede all prior or contemporaneous communications and proposals.

12.4 Amendment of Terms​

We reserve the right to modify these Terms at any time. The modified Terms will take effect when posted on our website. Your continued use of the service indicates your acceptance of the modified Terms.

12.5 Waiver and Severability​

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

12.6 Assignment​

You may not assign or delegate any rights or obligations under these Terms without our prior written consent. We may freely assign these Terms.

12.7 Data Storage Location​

Our servers and databases are located on the Microsoft Azure cloud service platform in the USA. By using our services, you consent to your data being transferred to and stored in the USA.
